General Terms and Conditions of Sale (GTCS)

These conditions govern the sale of holidays between Coume a Case Vincent and Nicolas Berthé-Monis and any person wishing to book accommodation via the coumeacase.com website.
Booking the Coume à Case gîte implies full acceptance of these terms and conditions of sale, without exception or reservation.
1. Reservation and contract
The reservation becomes effective on receipt of the deposit (or full payment, as the case may be), accompanied by acceptance of these conditions. A rental contract or written confirmation will be sent to the customer.
2. Prices and tourist tax
The prices shown are in euros, all taxes included, excluding tourist tax.
The tourist tax, collected on behalf of the communauté de commune de la vallée d'Ossau, is payable by the customer and will be specified at the time of booking.
3. Deposit and payment
A deposit of 30% is required on booking. The balance is payable 30 days before arrival or on arrival as agreed.
Methods of payment accepted: bank transfer, cheque, cash.
4. Cancellation by the customer
More than 30 days before arrival: the deposit is refunded in full.
Between 30 and 15 days before arrival, 50% of the deposit will be retained.
In the event of cancellation less than 15 days before the date of arrival, the full deposit will be retained.
If the cancellation is made less than 7 days before the arrival date or if the tenant does not show up (no-show), the full amount of the stay is due.
However, if the gîte is re-let for the same period, all or part of the sums paid may be reimbursed, less any costs incurred.
In the event of no-show or interruption of the stay: no refund will be made.
5. Cancellation by the owner
In the event of force majeure or the impossibility of accommodating a guest, the holiday will be reimbursed in full. No compensation can be claimed beyond the reimbursement of the sums paid. This reimbursement will be made within a maximum of 15 days from the date of cancellation.
6. Force majeure
In the event of an exceptional event beyond the tenant's control (serious illness, administrative ban on travel, natural disaster, etc.), a postponement of the stay may be offered, valid for 12 months, subject to presentation of supporting documents, from the date initially scheduled, at no additional cost.
The postponement must be made within the limits of calendar availability, and on condition that the postponed reservation corresponds to an equivalent duration.
If the tenant chooses to postpone the holiday to a period when prices are higher, the price difference must be paid at the time of rescheduling.
If the tenant chooses to postpone the holiday to a period when the rates are lower than those initially booked, no refund of the difference will be made.
If the Tenant refuses this postponement, no refund will be made, unless the Owner decides otherwise in exceptional circumstances.
7. Arrival and departure
The customer must arrive on the agreed date between 4.00 pm and 6.00 pm. In the event of late or delayed arrival, it is imperative to give notice (06 88 49 28 82).
Departure must be before 11.00 am on the day indicated.
8. Security deposit
A deposit of 400 euros may be requested on arrival. It will be returned after the inventory of fixtures on departure, after deduction of any damage or shortcomings.
If this amount does not cover all the costs of repairing any damage, whether intentional or unintentional, the tenant will be billed for the actual cost, based on receipts provided by Ad Hoc professionals for repair work.
9. Use of the premises
The tenant undertakes to respect the rented premises and to return them in the condition in which they were found. The accommodation is designed to sleep 6 people. Sub-letting is prohibited.
10. Pets
Pets are permitted in the gîte, provided that they do not cause a nuisance and that they are properly supervised by the tenant. However, pets are not permitted in the bedrooms.
The tenant is responsible for any damage caused by his/her pets during the stay. Any damage caused by the presence of pets (furniture, floors, bedding, etc.) will be charged to the tenant and may be deducted from the security deposit or invoiced as a supplement.
Pets are the sole responsibility of the tenant.
Animal excrement must be collected daily and disposed of properly. The tenant undertakes to maintain the gîte in a clean and hygienic condition throughout their stay. Failure to do so may result in additional cleaning charges.
The person responsible for the animal must take his/her animal with him/her whenever he/she leaves the gîte.
11. Liability
The owner declines all responsibility in the event of theft(s), loss(s) or damage(s) occurring during the stay, both on the premises and in the car park.
12. Disputes
In the event of a dispute, the parties will endeavour to find an amicable solution. If no agreement is reached, the dispute will fall within the jurisdiction of the court in the area of the rental location, i.e. : Tribunal judicaire de Pau, place de la libération, 64000 PAU.
